1. GENERAL INFORMATION
These Terms of Service (“Terms”) govern the use of:
- WebOrbiton self-hosted software (“Software”), and
- WebOrbiton Platform, required for obtaining a commercial license for SaaS projects exceeding SA-SDL license conditions (“Platform”).
By using either the Software or Platform, the user (“User”) accepts these Terms.
If the User does not agree to these Terms, they must stop using the Software or Platform.
The Software is operated by the User locally. The Platform is operated by:

2. LICENSES AND USE
2.1 Self-Hosted WebOrbiton
- Governed by SA-SDL and SA-SDCL.
- Users may modify, fork, or adapt the Software for personal or commercial projects.
- Offering the Software directly as a paid product or SaaS requires SA-SDCL approval.
2.2 WebOrbiton Platform
- Users must maintain a valid account to obtain a commercial license for SaaS projects exceeding SA-SDL limits.
- Access to the Platform is conditional on complying with these Terms and acceptable use rules.
3. ACCEPTABLE USE POLICY (AUP)
The User agrees NOT to:
- Launch or attempt DDoS attacks.
- Attempt unauthorized access to accounts, servers, APIs, or databases.
- Exploit bugs or Platform weaknesses for personal gain.
- Bypass commercial license restrictions or limitations.
- Abuse trial periods, or distribute malware.

Intentional misuse may result in account suspension, license revocation, or legal action.
4. ACCOUNT REGISTRATION AND LOGIN
Access to WebOrbiton Platform requires creation of a user account.
When creating an account, the User must:
- provide accurate and truthful information,
- use a valid email address they control,
- keep login credentials confidential,
- not share account access with third parties.
The User is responsible for all activity performed through their account.
If the User suspects unauthorized access, they must immediately notify WebOrbiton Team at:
support@weborbiton.com
WebOrbiton Team reserves the right to:
- suspend accounts showing suspicious activity,
- require additional verification,
- temporarily block access for security reasons.
5. PROHIBITION OF MULTIPLE ACCOUNTS
Each individual or organization may maintain only one active account on WebOrbiton Platform, unless explicitly approved in writing by WebOrbiton Team.
The following actions are strictly prohibited:
- creating multiple accounts to bypass license limits,
- creating duplicate accounts to avoid payments or restrictions,
- using different emails or identities to gain additional benefits,
- operating multiple accounts under false or misleading information.
Violation of this rule may result in:
- immediate suspension of all related accounts,
- permanent ban from the Platform,
- loss of access to stored data,
- refusal of future services or commercial licenses.
Requests for multiple accounts (e.g., for teams or organizations) must be submitted to:

6. SUBSCRIPTIONS, PAYMENTS, AND REFUNDS (WebOrbiton Platform)
Paid plans or commercial license fees are billed monthly or annually.
The User agrees to:
- provide accurate billing information,
- allow automated renewal unless cancelled,
- understand failed payments may suspend access or revoke licenses.
Refunds or exemptions apply if:
- Prolonged outages or malfunctions result directly from WebOrbiton Platform errors.
- Platform services fail due to bugs or system faults.
Affected Users may receive:
- pro-rata refunds,
- exemption from subscription or license fees for the affected period.

Decisions are at WebOrbiton Platform discretion.
7. FEATURES AND SERVICE LEVELS
Platform services are provided on a best-effort basis, without guaranteed uptime,
unless stated in a separate SLA.
8. ACCOUNT TERMINATION
An account may be terminated if:
- Terms are violated.
- Harmful or illegal activity is detected.
- Subscription payments fail (Platform only).
- Deletion is requested.
Upon termination:
- license records may be deleted after 30 days.
9. LIABILITY AND WARRANTY
The Software or Platform is provided “AS IS”.
WebOrbiton Team is not responsible for:
- outages or downtime unrelated to Platform errors,
- data loss due to misconfiguration (Software or Platform),
- indirect or financial damages unrelated to Platform errors.
Maximum liability is 1 USD, except for Platform errors causing prolonged
service disruption, in which case refunds or fee exemptions apply.
10. PRIVACY AND DATA PROTECTION (GDPR)
WebOrbiton Platform complies with GDPR and Polish data protection laws.
Data is processed for:
- verifying licenses,
- improving system stability,
- delivering alerts and support.
Data is never sold.
Self-hosted users are responsible for compliance when deploying the Software.
11. TRADEMARKS AND BRAND USAGE
“WebOrbiton”, the logo, favicon, and Platform branding are trademarks.
Users may not:
- use logos outside the Platform or locally without permission,
- publish modified variants implying partnership.
12. FINAL PROVISIONS
These Terms are governed by Polish law.
Disputes are handled by Polish common courts.
Continued use of Software or Platform implies acceptance of these Terms.
